Divorce and judicial separation can be done by representative. If you live outside Peru, you can grant a power of attorney to present a divorce or judicial separation sue before the appropriate judge.
Many spouses get separated (example: one of then leaves the country) and don't do the judicial process thinking that they can just postpone it. This is a mistake because been married has its consequences like:
- All the thins you adquired belong to both spouses (although the 27495 law has made some exceptions).
- If one ot the spouses die the other will be his/her heir. If the dead left a concubine he/she will not receive any benefit even though they've been together for a long time.
- Debts that one of the spouses assume could be satisfied with the goods of the other.
- If one ot the spouses gets married without been divorced will be charged with bigamy which is a crime.
